ABC’s default notice from the Port is now available. The Port of Bellingham has found ABC Recycling in default of its lease down at the Bellingham Waterfront, just 18 months into its possibly 25 year lease. The notice of default can be found here:
It should be known the failure to comply with stormwater management has been known since 2022, and the Port failed to act to keep the Bay safe. To date, the metal pile has not been reviewed for environmental impacts, and is a heavy industrial (HI) activity in an area that does not allow HI. Here is a quick summary of the notice: This letter from the Port of Bellingham to A.B.C Recycling Operations Corp (ABC) outlines three separate Notices of Default. Unauthorized Berthing: ABC breached the Lease by berthing a vessel without permission in a location not designated in the Lease. They have 30 days to comply by refraining from unauthorized berthing and following proper procedures for berthing. Failure to Comply with Stormwater Management: ABC failed to adhere to stormwater management requirements as per the Lease and NPDES Industrial Stormwater General Permit. They must implement appropriate Best Management Practices (BMPs) to avoid further violations within 30 days. Insurance Requirements: ABC did not procure or maintain the required insurance coverage as outlined in the Lease. They must rectify this within 30 days. The letter warns that failure to comply may lead to legal action, including eviction and possible additional damages. Even if the defaults are cured, any subsequent violation within a year could result in eviction. ABC’s vacating the premises doesn’t absolve them of contractual obligations.
